Terms of Service

These Terms govern your use of Gundur (the "Service"). By creating an account or otherwise using the Service, you agree to these Terms. If you do not agree, do not use the Service.

Plain-language summary: be honest, don't post anything illegal or harmful, you own what you write but you let us host and display it, and Gundur is a tool for sharing diagnostic knowledge — not a substitute for a professional in safety-critical situations.

1. Who we are

Gundur is operated by Pedro Neves, a sole proprietorship (eenmanszaak) registered in the Netherlands. KvK 95247718 · VAT NL005140265B92. Contact: support@gundur.ai.

2. Eligibility

You must be at least 16 years old to use Gundur. By using the Service you confirm that you meet this age requirement and have the legal capacity to enter into these Terms.

If you use Gundur on behalf of an organisation, you represent that you have authority to bind that organisation to these Terms.

3. Your account

• You are responsible for keeping your credentials confidential and for activity under your account.
• You must provide a valid email address; that address must be one you control.
• You may not impersonate another person or misrepresent your affiliation with anyone.
• Notify us promptly at support@gundur.ai if you suspect unauthorised access.
• You can delete your account at any time from the profile page or by emailing us.

4. Your content

"Your Content" means anything you create on Gundur — diagnostic documents, remedy documents, trees, comments, replies, uploaded media, and similar.

a. Ownership

You retain all rights you already had in Your Content. These Terms do not transfer ownership of Your Content to us.

b. Licence you grant us

To operate the Service, you grant Gundur a worldwide, non-exclusive, royalty-free licence to host, store, reproduce, display, adapt (for formatting and translation purposes), and distribute Your Content as needed to provide the Service. This licence is limited to operating Gundur and ends when you delete the content, except as described in §4(c).

c. Public content and forks

If you publish content publicly on Gundur, other users may view it, comment on it, link to it from their own diagnostic trees, or build derivative trees that reference it. Once another user has incorporated your published content into their tree, deleting your account or your document does not retroactively remove the rendered text from their tree, although your authorship attribution may be removed. You can request narrower scrubbing by emailing privacy@gundur.ai.

d. Responsibility for what you post

You represent that Your Content does not infringe anyone's intellectual property, privacy, or other rights, and that you have all the rights necessary to grant the licence above. You are responsible for Your Content.

5. Acceptable use

You agree not to:

• Post anything unlawful, defamatory, harassing, threatening, hateful, or that incites violence.
• Post content that exploits or endangers minors.
• Post sexually explicit material, gratuitous gore, or shock content.
• Post diagnostic content intended to cause harm (e.g. instructions to disable safety mechanisms, falsified medical advice intended to mislead).
• Post spam, scams, phishing, malware, or links to such material.
• Infringe intellectual property rights or pass off others' work as your own.
• Collect personal data about other users without their consent.
• Circumvent or attempt to circumvent App Check, rate limits, or any other security or anti-abuse mechanism.
• Scrape the Service at scale, or use automated tools to access it except through official APIs.
• Use the Service to train machine-learning models without our written permission.
• Reverse-engineer the Service or its security controls.
• Use the Service in ways that violate Dutch, EU, or other applicable law (including export-control and sanctions law).

We may remove content or suspend accounts that violate these rules, at our reasonable discretion. For serious or repeated violations we may terminate the account.

6. AI features

Gundur offers AI-assisted features that generate draft diagnostic content. These drafts are produced by third-party language models and may be inaccurate, incomplete, or unsuitable. You are responsible for reviewing AI output before publishing it under your account. AI-generated content you publish is treated as Your Content under §4 and you are responsible for it on the same terms.

7. Diagnostic content is not professional advice

Gundur is a platform for sharing structured diagnostic knowledge. It is not a substitute for qualified professional advice. Content on Gundur is contributed by users and is not verified by us.

• For matters of human or animal health, consult a licensed medical or veterinary professional.
• For safety-critical electrical, gas, structural, or vehicle work, consult a licensed professional and follow manufacturer and regulatory guidance.
• For legal or financial diagnostics, consult a qualified adviser in your jurisdiction.

You use Gundur's content at your own risk. To the extent permitted by law, neither Gundur nor contributors are liable for outcomes resulting from your reliance on user-contributed content.

8. Intellectual property

The Gundur name, logo, branding, software, interface, and underlying code are owned by Gundur (Pedro Neves) and protected by intellectual property law. These Terms do not grant you any right to use our trademarks or branding except where strictly necessary to refer to the Service.

9. Reporting infringement

If you believe content on Gundur infringes your rights (including copyright), email support@gundur.ai with: a description of the work, the URL of the infringing content, your contact details, and a statement that you have a good-faith belief that the use is not authorised. We respond to legitimate notices in accordance with EU Digital Services Act obligations.

10. Service availability and changes

We work to keep Gundur available but do not guarantee uninterrupted or error-free operation. We may add, change, or remove features, and may impose reasonable limits on use (such as rate limits, storage limits, or AI quota). We will give reasonable advance notice of changes that materially reduce the Service's functionality where it is feasible to do so.

11. Pricing and free tier

Gundur is currently free to use. If we introduce paid features in the future, we will give you notice and an opportunity to review the applicable pricing terms before they apply to you.

12. Disclaimers

To the maximum extent permitted by applicable law, the Service is provided "as is" and "as available", without warranties of any kind, whether express or implied, including implied warranties of merchantability, fitness for a particular purpose, accuracy, or non-infringement. We do not warrant that the Service or any content on it is accurate, complete, current, or reliable.

13. Limitation of liability

Nothing in these Terms limits any liability that cannot be limited under Dutch law, including liability for death or personal injury caused by negligence, fraud, or intentional misconduct, or any other liability that cannot be lawfully excluded.

Subject to the above, to the maximum extent permitted by law:

• Gundur is not liable for indirect, consequential, incidental, special, or punitive damages, or for loss of profits, revenue, goodwill, or data.
• Gundur's total aggregate liability arising out of or related to your use of the Service is limited to the greater of (a) the amount you have paid Gundur in the twelve months preceding the event giving rise to the claim, or (b) one hundred euros (€100).

14. Indemnification

You agree to indemnify and hold Gundur harmless from any third-party claim, demand, or proceeding (including reasonable legal fees) arising from Your Content, your use of the Service, or your breach of these Terms or applicable law.

15. Suspension and termination

You may stop using the Service and delete your account at any time. We may suspend or terminate your access if you breach these Terms, if your use creates legal risk for us or other users, or if we discontinue the Service. Where feasible and lawful, we will give you reasonable notice and an opportunity to export Your Content.

Termination does not affect rights or obligations that, by their nature, should survive — including §4 (the licence over published content already incorporated by others), §8 (intellectual property), §12–14 (disclaimers, liability, indemnification), and §17 (governing law and disputes).

16. Privacy

Our handling of personal data is described in the Privacy Policy, which forms part of these Terms.

17. Governing law and disputes

These Terms are governed by the laws of the Netherlands, excluding its rules on conflict of laws. The UN Convention on Contracts for the International Sale of Goods does not apply.

Disputes arising out of or related to these Terms or the Service will be brought exclusively before the competent courts of Amsterdam, the Netherlands, unless mandatory law gives you the right to bring proceedings in another jurisdiction (for example, the courts of your habitual residence if you are a consumer in the EU).

If you are a consumer in the EU, you may also access the European Commission's Online Dispute Resolution platform at ec.europa.eu/consumers/odr.

18. Changes to these Terms

We may update these Terms from time to time. If a change is material, we will give you reasonable notice (for example, by email or an in-product banner) before it takes effect. Continued use of the Service after a change takes effect constitutes acceptance of the updated Terms. If you do not accept a change, you may delete your account.

19. Miscellaneous

• Entire agreement. These Terms, together with the Privacy Policy and Cookie Policy, constitute the entire agreement between you and Gundur regarding the Service.
• Severability. If any provision is held unenforceable, the remaining provisions remain in full force.
• No waiver. Failure to enforce a provision is not a waiver of our right to enforce it later.
• Assignment. You may not assign these Terms without our prior written consent. We may assign these Terms in connection with a merger, acquisition, or sale of substantially all of our assets, on notice to you.
• Language. These Terms are written in English. Any translation is for convenience only; the English version controls.
